These Terms & Conditions govern your use of kanchenjungaguides.com and your booking or participation in trekking, tours, expeditions, and other travel services arranged by us.

By submitting an inquiry, making a booking, paying for a trip, or participating in a trip arranged by us, you acknowledge that you have read and accepted these Terms & Conditions.

1. About Kanchenjunga Guides

Kanchenjunga Guides provides trekking and travel services in the Kanchenjunga region and other destinations where services are offered through the website.

Our services may include:

  • Kanchenjunga Base Camp treks
  • Kanchenjunga Circuit treks
  • Sele La Pass treks
  • Customized and private treks
  • Guided trekking experiences
  • Accommodation arrangements
  • Transportation
  • Trekking permits and documentation
  • Guides and porters
  • Other travel-related services

Certain trekking routes in Nepal require trekkers to travel with a licensed guide and obtain the applicable permits and TIMS through a registered trekking agency. Requirements may change according to government regulations and official notices.

2. Booking Confirmation

A booking becomes confirmed only after we have received the required booking information and payment and have provided written confirmation.

The booking confirmation may include:

  • Trip name
  • Travel dates
  • Number of travelers
  • Agreed itinerary
  • Services included
  • Services excluded
  • Payment details
  • Other relevant arrangements

A quotation or itinerary provided before confirmation does not necessarily constitute a confirmed booking.

3. Booking Information

You are responsible for providing accurate information when making a booking.

This may include:

  • Full name
  • Passport information
  • Nationality
  • Date of birth
  • Contact information
  • Emergency contact
  • Travel dates
  • Dietary requirements
  • Medical or health information relevant to the trek
  • Other information required for permits and travel arrangements

Incorrect or incomplete information may result in additional costs, delays, permit issues, or changes to your trip.

4. Payment

Payment requirements vary depending on the trip and booking arrangements.

Your quotation or booking confirmation will specify the applicable:

  • Deposit amount
  • Payment deadline
  • Remaining balance
  • Payment method
  • Currency
  • Applicable fees

All payments must be made through the payment methods provided or approved by Kanchenjunga Guides.

Third-party payment processing fees, bank charges, currency conversion charges, or other transaction costs may apply where applicable.

5. Prices

Prices are based on the services and itinerary stated in your quotation or booking confirmation.

Prices may change before booking confirmation due to changes in:

  • Government fees
  • Permit fees
  • Transportation costs
  • Accommodation costs
  • Airline or flight charges
  • Exchange rates
  • Local operating costs
  • Other unavoidable operational expenses

Once a booking has been confirmed, any additional mandatory government or supplier charges arising afterward will be communicated to the client where applicable.

6. Permits and Government Requirements

Many Kanchenjunga trekking routes require permits and other official documentation.

We may arrange applicable permits, TIMS, conservation-area permits, restricted-area permits, and other documentation on behalf of travelers where included in the agreed package.

Permit requirements, fees, route restrictions, and government regulations can change without prior notice.

Travelers must provide accurate documents and information required for obtaining permits.

We are not responsible for delays or inability to obtain a permit caused by incorrect, incomplete, expired, or late documentation supplied by the traveler.

7. Passport, Visa and Travel Documents

Travelers are responsible for ensuring that they have:

  • A valid passport
  • Appropriate Nepal visa or entry permission
  • Required travel documents
  • Appropriate travel insurance
  • Any documentation required for their nationality or itinerary

We can provide general travel information but travelers remain responsible for verifying their own entry and travel requirements with the relevant authorities.

8. Itinerary Changes

Mountain trekking is affected by weather, terrain, transportation, accommodation availability, government regulations, trail conditions, and other factors.

For safety and operational reasons, we may modify the itinerary when reasonably necessary.

Changes may include:

  • Altering walking distances
  • Changing overnight locations
  • Changing accommodation
  • Changing transportation
  • Changing the trekking route
  • Delaying or advancing a particular section
  • Returning to a lower elevation
  • Cancelling a particular section of the itinerary

Where practical, we will discuss significant changes with travelers and seek an appropriate alternative.

9. Weather, Natural Events and Unavoidable Circumstances

Himalayan trekking involves circumstances beyond our reasonable control.

These may include:

  • Severe weather
  • Heavy snowfall
  • Landslides
  • Floods
  • Earthquakes
  • Avalanches
  • Trail closures
  • Road blockages
  • Flight cancellations or delays
  • Government restrictions
  • Political disturbances
  • Strikes
  • Natural disasters
  • Health emergencies
  • Other extraordinary circumstances

When such circumstances occur, our priority is the safety of travelers, guides, porters, and other members of the group.

Additional expenses resulting from unavoidable circumstances may be the responsibility of the traveler where they are not included in the original package.

10. High-Altitude Trekking and Personal Responsibility

Kanchenjunga trekking involves high altitude, remote terrain, changing weather, long walking days, and limited access to medical facilities.

Travelers are responsible for honestly informing us about relevant medical conditions, medications, allergies, dietary requirements, or other circumstances that may affect their safety.

We may recommend changing, delaying, shortening, or ending a trek when a traveler or guide believes continuing presents a significant safety concern.

No trekking itinerary can guarantee that altitude sickness, injury, illness, evacuation, or other incidents will not occur.

11. Travel Insurance

Comprehensive travel insurance is strongly recommended for all travelers.

For high-altitude trekking, insurance should appropriately cover the activities and maximum altitude of the planned trek and, where available, emergency medical treatment and evacuation.

Travelers should carefully review their insurance policy before departure.

Kanchenjunga Guides is not responsible for expenses that are not covered by the traveler's insurance policy.

12. Guides and Porters

We provide guides and porters according to the agreed trekking package and operational requirements.

Guides may make reasonable decisions concerning route changes, walking schedules, rest days, accommodation, or descent based on safety and local conditions.

Travelers are expected to respect guides, porters, local communities, accommodation staff, and other service providers.

13. Accommodation and Transportation

Accommodation and transportation are provided according to the itinerary and package inclusions.

In remote trekking areas, accommodation standards may be basic and can vary between locations.

Room availability, transportation schedules, road conditions, and local operating circumstances may require changes.

Where a listed accommodation or transportation service becomes unavailable, we may arrange a reasonably comparable alternative where possible.

14. Flights and Transportation Delays

Domestic mountain flights and road transportation may be affected by weather, operational conditions, technical problems, airport restrictions, or other circumstances.

We may assist with alternative arrangements where possible.

Additional costs arising from delays, cancellations, additional accommodation, meals, transportation, or other services may be payable by the traveler unless otherwise covered by the agreed package or applicable provider terms.

15. Personal Belongings

Travelers are responsible for their personal belongings, documents, equipment, money, electronics, and valuables throughout the trip.

We recommend keeping important documents and valuables secure and carrying appropriate travel insurance.

Kanchenjunga Guides is not responsible for loss, theft, or damage to personal belongings except where liability is imposed by applicable law.

16. Photography and Content

Travelers may be photographed or filmed during trips for personal memories.

We will not intentionally use identifiable traveler photographs for promotional purposes without appropriate permission where such permission is required.

Travelers should respect the privacy, traditions, religious practices, and cultural sensitivities of local communities.

17. Responsible Travel

Travelers are expected to follow responsible trekking practices, including:

  • Respecting local culture and traditions
  • Avoiding unnecessary environmental damage
  • Following designated trails
  • Disposing of waste responsibly
  • Respecting wildlife
  • Following guide and safety instructions
  • Avoiding behavior that may endanger themselves or others

18. Cancellation and Refunds

Cancellation and refund conditions depend on the specific booking and applicable cancellation policy.

Where a separate Cancellation Policy applies, that policy forms part of these Terms & Conditions.

Government permits, tickets, accommodation, transportation, or other services that have already been purchased or become non-refundable may not be refundable.

Travelers should review the applicable cancellation terms before making payment.

19. Early Return or Incomplete Trek

If a traveler voluntarily leaves a trek early, decides not to continue, or is unable to complete the itinerary for personal reasons, unused services are generally not refundable unless otherwise agreed.

If a trek must be shortened or terminated because of safety concerns, weather, illness, injury, government restrictions, or other circumstances beyond our reasonable control, refund eligibility will depend on the circumstances and amounts recoverable from suppliers.

Additional costs for accommodation, transportation, food, evacuation, or other services may apply.

20. Emergency Evacuation

In the event of an emergency, we may assist in coordinating evacuation, medical support, transportation, or other emergency arrangements.

The cost of emergency services, including helicopter evacuation where required, is generally the responsibility of the traveler or their insurance provider unless otherwise stated in writing.

21. Website Information

We make reasonable efforts to keep the information on our website accurate and current.

However, trekking conditions, prices, government requirements, accommodation, transportation, availability, and itineraries may change.

Website content should therefore be considered general information unless specifically confirmed in writing as part of a booking.

22. Third-Party Services

Nothing in these Terms & Conditions is intended to exclude or limit liability where such exclusion or limitation is prohibited by applicable law.

24. Traveler Conduct

We reserve the right to take reasonable action if a traveler:

  • Endangers themselves or others
  • Seriously violates local laws
  • Harasses guides, porters, staff, or other travelers
  • Damages property
  • Engages in abusive or threatening behavior
  • Refuses to follow reasonable safety instructions

In serious circumstances, the trip may be terminated without refund, subject to applicable law and the circumstances of the case.

25. Website Use

You agree not to:

  • Use the website for unlawful purposes
  • Attempt unauthorized access to website systems
  • Upload malicious software or harmful content
  • Misuse website forms or services
  • Copy or reproduce website content without permission
